On August 6, 2020, division number 4 police station booked Dheeraj Kumar of New Patel Nagar in Haibowal and Pawan Kumar of Lajpat Nagar, Noorwala Road, under the relevant sections of the NDPS Act.
According to the prosecution, the police were on special duty due to the Covid-19 pandemic in Mali Ganj Chowk when an informer alerted them that the accused, who habitually sells intoxicant tablets, was coming on his scooter with a large quantity of these tablets.
During the check, the accused was seen coming from the Meena Bazar side on a scooter. Upon seeing the police, he tried to turn back but fell off his Activa.
A heavy plastic sack was found lying on the footrest of his scooter. The police later recovered intoxicant tablets from the bag and arrested him.
A subsequent search of Pawan Kumar’s shop led to the recovery of currency notes amounting to Rs 97,770, one LG CPU, a mobile phone, and a licence in the name of Balaji Trader registered to Pawan Kumar.
The court, however, acquitted accused Pawan Kumar and held that mere oral version that too as hearsay evidence does not bring out any case against him, especially when nothing has been recovered from the accused.
